This matter has been taken by me through Video Conferencing.
Ld. Counsel for the appellant states that his belongings are lying in the premises in question of which the respondent has taken possession on 28.06.2022. He further states that his limited prayer is that the appellant who was a tenant in the premise should be allowed to remove all the goods and belongings from the premises.
Ld. Counsel for the Respondent has no objection of the same.
Ld. Counsel for the Appellant prays that he requires at least seven days time to remove his goods.
Heard. The prayer is allowed in view of the no objection by the Ld. Counsel for the Respondent. Let the appellant start the process of removal of goods from 26.07.2022 and he is directed to remove all his goods by 02.08.2022.
Ld. Counsel for the appellant further prays that in case the auction takes place, a notice may be given to him in this regard as he is interested in purchasing the property in question. Without going into the merits of the case whether the notice is required to be served or not or before the appellant, the Sr. Manager of the Respondent bank states that she will inform the appellant whenever the auction is scheduled.
In view of the above, Ld. Counsel for the appellant withdraws the present appeal.
