Learned counsel for Appellant submits that substitute service on Respondent Nos.3A to 3D who were impleaded as Legal Heirs of deceased Respondent No.3 has already been effected and the proof of publication is produced on 15.11.2017. The appellant has erroneously filed another M.A. No. 130/2019 for notice by way of publication in newspapers, which was in fact not required. Hence, the learned counsel for the Appellant seeks permission to withdraw M.A. No. 130/2019 as not pressed.
In view of above, M.A. No. 130/2019 is dismissed as not pressed.
Respondent Nos.3A to 3D are set ex-parte.
Post on 11.07.2022 for ex-parte hearing.
