THE APPELLATE TRIBUNAL :
Heard the Appellant in person as well as Learned Counsel for Respondent Bank and perused the record.
Order was passed by the Hon’ble High Court at Calcutta on 15th November, 2022 wherein it was expected that the matter may be concluded within a reasonable period of time.
Record shows that initially the instant appeal was preferred without making any challenge to any order; rather a prayer was made for direction to the Bank to issue No Due Certificate and return the title deed and also initiate an enquiry into the allegations of perjury.
On 25th August, 2022 an application, being I.A. 251 of 2021 was filed by the Appellant for amendment when the Respondent was afforded an opportunity to file objection within three weeks and further the Appellant may file rejoinder within two weeks thereafter and the matter was fixed today.
