Learned counsel for the appellants states that appellants had filed an LPA (No.28/2022) before the Hon’ble Delhi High Court as this Tribunal was not functional and vide its order dated 27.07.2022, the Hon’ble High Court while dismissing the said LPA had granted 15 days interim protection to the appellants by ordering that the order dated 14.12.2021 passed by the Hon’ble Single Judge of the Hon’ble High Court in the writ petition (No.12503/2021) would remain in abeyance. Learned counsel for the appellants further submits that vide order dated 14.12.2021 the Single Bench of the Hon’ble High Court had dismissed the writ petition, which was filed by the appellant seeking direction to keep the orders dated 08.03.2021 and 08.10.2021 passed by CMM, Delhi along with notice dated 30.10.2021 issued by the Receiver in abeyance till the appellants get a proper hearing before this Tribunal as at the time of filing the writ petition this Tribunal was not functional, but permitted the appellants to approach this Tribunal under the SARFAESI Act and extended the interim protection granted to the appellants vide order dated 08.11.2021 by further four weeks.
