The Ld. Counsel for applicant has moved present application to recall order dated 27.09.2021 whereby appeal was dismissed for want of 25% predeposit.
Ld. Counsel for applicant submits that decretal amount was Rs58.72 lacs. She states that property has been sold in auction for an amount of Rs.48.00 lacs and she will deposit 25% pre-deposit of remaining amount along with application for waiver of rest within 15 days. Let her do so within 15 days.
List this matter for 14.12.2022 for hearing on pre-deposit.
