The Ld. Counsel for the Appellants seeks adjournment again. Vide order dated 27.06.2022 it was made clear that no further adjournment would be granted and that the Appellants shall get ready for hearing or face dismissal of the Appeal.
Today, when the matter is taken up for hearing. Unfortunately, the Appellants are again not ready for a hearing. It is pertinent to note that this is an appeal which was earlier dismissed for default in 2014 and was restored in 2017. This attitude of the Appellants cannot be encouraged. Therefore, the adjournment is granted on the payment of costs of Rs.10,000/- to D.R.T. Bar Association, Mumbai for purchasing the books within two weeks, failing which the Appeal shall stands dismissed.
