Ld. Counsel Ms. Sharmistha Poddar is present on behalf of appellant and files affidavit of service of summon. Hand service upon respondent No. 1&2 is confirmed and postal service upon respondent No. 3 showing that postalreceipts is enclosed but postal tracking report is not enclosed.
Ld. Counsel for appellant submits that instead of 13(2) notice they enclosed order dated 20/12/2020 of District Magistrate at page No. 289-292 of Vol.II in respect of claim amount. Hence the only defect mentioned in order dated 07/04/2022 is removed.
Ld. Counsel Ms. Ranjabati Ray is present for respondent No. 1 & 2 and undertakes to file vakalatnama by next date.
Post the matter on 17/08/2022 for filling affidavit of service upon respondent No. 3.
