The matter is taken up for hearing by way of Praecipe dated 23.06.2022 filed by Appellant for seeking urgent relief.
Heard submissions made by both sides and on perusal of the records pertaining to the NCLT and NCLAT and the documents which have been relied upon by both sides, and also on going through the reply and rejoinder, I find that instead of hearing the application for stay, the regular Appeal itself can be heard on 04.07.2022., the date on which it is already posted. As submitted by both sides, the symbolic possession is already taken by the Appellant and physical possession is scheduled to be taken. The learned counsel for Respondents undertakes that no third party rights will be created in respect of the property.
Both parties shall maintain status-quo till next date.
Post on 04.07.2022 for hearing.
