Respondent No.2 has died and the Appellant has filed I.A. No.96/2022 for bringing on record Legal Heirs of the said deceased Respondent. However, there is a delay of 96 days in filing this application for bringing on record the Legal Heirs and the Appellant has filed I.A. No. 97/2022 for condonation of delay of 96 days in filing I.A. No. 96/2022.
In view of the application and affidavit filed in support of the application for condonation of delay, I am convinced that the reasons contained in the application for condonation of delay are acceptable, hence the delay is condoned and the application for impleading Legal Heirs is allowed. The consequential amendment in the causal tile shall be carried out within a period of two weeks.
Proposed Respondents have been served. But, none appears for them.
Post on 13.05.2022 before Registrar for compliance.
