Learned counsel for the appellant submits that there are only two submissions, first is that the account was not maintained properly by the respondent-Bank and the second that the property in question cannot be sold at the distress value for the very first time in view of the judgment passed by the Hon’ble Supreme Court in the matter of Anil Kumar Srivstava Vs. State of U.P. & Another on 20.08.2004, copy of which has been produced before this Tribunal.
