Appeal No. 24 of 2020 is preferred by the Secured Creditor, i.e. the Authorised Officer, State Bank of India, while Appeal No. 21 of 2021 is preferred by the Auction Purchaser, Ajeet Sahu, who is Respondent No. 2 in Appeal No. 24 0f 2020. 3. Facts in brief are that Respondent No. 1, i.e. Ladu Kishore Rauta, availed a Term Loan of Rs.9,88,000.00 in the year 2015 to build a house over Plot No. 112/1191 Khata No. 308/12, Mouza - Guranda, Tahsil – Khalikote, District : Ganjam. The aforesaid property was secured as colateral security; there was default in payment; loan was classified as N.P.A. on 31st January, 2017; proceedings uunder SARFAESI Act 2002 was initiated by the Secured Creditor; notice under Section 13 (2) was issued on 21st March, 2017 demanding Rs.10,85,856.00; symbolic possession was taken under Section 13 (4) of the SARFAESI Act 2002 on 18th My, 2018.
