This matter has been taken up by me through Video Conferencing.
Learned counsel or the appellants submits that as per the notice under Section 13(2) of the SARFAESI Act, the respondent FI had demanded a sum of Rs.5,20,22,575/-, out of which the appellants have already made a payment of about Rs.1.40 crores. He further submits that as per the own calculation of the appellants 25% of the balance amount comes to Rs.96.11 lakhs which the appellants have deposited with this Tribunal towards pre-deposit.
Issue notice of the application for waiver of pre-deposit (I.A. No.844/2022) and the appeal to respondents by all permissible modes for 22.12.2022. Notice in the appeal is, however, subject to the decision to be taken on the waiver application after hearing the opposite counsel.
