At the outset it is submitted that during pendency of the Appeal, Respondent No. 3, Allahabad Bank, has merged with Indian Bank but substitution application has yet not been filed for substituting Indian Bank in place and stead of Punjab National Bank.

Appellants are directed to file proper substitution application within a week with advance copy to Learned Counsel for Respondents; who, in turn, may file rejoinder with advance copy to Learned Counsel for Appellants.
