Ld. Counsel Mr. Saket Chaudhary is present on behalf of appellant and files affidavit of service of newspaper publication one in English and another in vernacular. However, in case of vernacular newspaper, notice has been published in English language.Ld. Counsel for appellant submits that advertising agent expressed their inability to publish the summons in vernacular language because they are not used to such publication in Visakhapatnam. Hence, he submits that service may be treated as complete and prays to place the matter before the Hon’ble Chairperson.
It is observed that service upon respondent no.1 is served by hand upon Ld. Counsel of the respondent and same has been acknowledged on the front page of the paper book Vol.I.
It is also observed from affidavit of service filed on 26.08.2022 that service upon respondent no.4 is effectively delivered.
Ld. Counsel Ms. Saswati Sikder is present on behalf of respondent No. 1.
None appears for other respondents.
The matter may be placed before the Hon’ble Chairperson on 02/02/2023 for further proceedings.
