The present appeal has been filed against the order dated 25.02.2022 passed by the DRT, Lucknow in M.A. No. 67/2008 arising out of T.A. No. 821/2002.
The report of the Registrar dated 25.05.2022 indicates that as per the learned counsel for the appellant, there is no debt due, as the defendant no. 2 in the said T.A., who is appellant No. 2 in the present appeal, had deposited the whole compromise amount in the Bank.
As per the record, the appeal has been filed within time, if calculation is made from the date of receipt of the free certified copy of the impugned order. In view of this, there is no delay in filing the present appeal.
Issue notices to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 30.01.2023 for service.
