Learned counsel for the appellants submits that the matter has been settled between the parties under the OTS, therefore, he does not want to press the present appeal.
Learned counsel for the respondent-Bank has no objection, but he submits that the amount deposited by the appellant towards pre-deposit with this Tribunal may be released in favour of the Bank.
Let the same be released in favour of the respondent-Bank within fortnight.
In view of the above, the appeal is dismissed as withdrawn with no order as to costs.
