This matter has been taken up by me through Video Conferencing.
This is an application filed by the applicant for issuing directions to the Ld. DRT-III, Delhi to dispose of the matter at the earliest. Learned counsel for the applicant states that on the one hand his application under Order IX Rule 13 CPC is pending before the learned DRT since 2018 and on the other, respondent bank is pressing hard for recovery before the learned Recovery Officer where the next date fixed for hearing is 01.09.2022. He further submits that the next date before the learned Presiding Officer is 15.10.2022.
Ld. Counsel for the respondent bank undertakes that he will not press his relief before the Recovery Officer on the next date of hearing.
Let the matter be heard by the Ld. DRT-III, Delhi on 15.10.2022 and dispose of the same preferably within a period of one month.
The application stands disposed of accordingly.
The date of 02.09.2022 stands cancelled.
