This matter has been taken up by me through Video Conferencing today upon mentioning by the Ld. Counsel for appellant that the Hon’ble High Court of Delhi has directed the matter to be listed before this Tribunal on or before 19.11.2022.
Miscellaneous Application No. 120/2022
As per order of the Hon’ble Delhi High Court dated 14.11.2022 the appellant has deposited Rs.1.42 crores with the Registry of the Hon’ble High Court which is yet to be transmitted to DRAT.
Ld. Counsel for appellant states that the aforesaid process will take another 4-5 days and Ld. Counsel for respondent FI also agrees to the same. Ld. Counsel for parties state that let appeal be heard thereafter.
In the meanwhile, the Ld. Counsel for respondent has put a proposal that amount deposited by the respondent no.2 i.e. Allahabad Bank (Indian Bank) before the Hon’ble High Court pursuant to the order dated 13.10.2022 may be released to the respondent FI and direction may be issued Ld. DRT to decide the S.A. finally in a time-bound manner.
Ld. Counsel for appellant states that let order for depositing Rs.1.42 crores be first complied with and in the meanwhile, he will take instructions from his client.
List the matter for 24.11.2022 for arguments. In the meanwhile, the appellant may approach the respondent FI for settlement as per direction of Hon’ble High Court.
