Pursuant to the notice issued, Mr. Sandeep Bhutani, Branch Manager of Allahabad Bank is present today along with Mr. A.K. Jain, learned counsel. Learned counsel Mr. A.K. Jain states that the FDRs in question cannot be released at present as they have been detained because of court orders. He seeks time to go into the record and make his submissions.
Heard. The dispute relating to release of FDRs is not before this Tribunal in appeal and no further proceedings are required to be conducted by this Tribunal to the effect whether the FDRs should be released or not.
At this stage, Mr. Dinkar Singh, the learned counsel for Pegasus Assent Reconstruction Co. states that the appellant has first to cross the hurdle of predeposit without which his appeal cannot be entertained.
Heard. Till now, at request of the parties, this Tribunal was only exploring the possibility of amicable settlement, but since the settlement has failed, appellant will have first to cross the hurdle of pre-deposit and only thereafter, the appeal can be entertained by this Tribunal.
The learned counsel for the appellant prays for an adjournment for making submissions on the pre-deposit issue.
