This matter has been taken up by me through Video Conferencing.
This is an appeal to modify the impugned order dated 05.02.2022 passed by DRT-I, Delhi in S.A. No.52/2022 titled ‘Phoenix ARC vs. South Indian Bank’ directing South Indian Bank not to take any measure / action, whatsoever, qua the property bearing House No.52, Block-E, First Floor, New Multan Nagar, New Delhi under the provisions of the SARFAESI Act, 2002 or otherwise till the pendency of S.A. No.52/2022. Ld. Counsel for the appellant submits that the S.A. has already been listed for 11.05.2022 before the DRT and prays that a direction may be given to the DRT to decide the S.A. on the said date.
Issue notice of the appeal to respondents for 04.04.2022.
