Vide this order I shall dispose of the present miscellaneous appeal filed against the impugned order dated 06.08.2022 whereby applications of defendants no.1 to 3 for condonation of delay for filing the written statement was dismissed by Ld. DRT-III, Delhi .
Ld. Counsel for the appellants has prayed for placing on record the written statements of defendants no.1 to 3 which has been denied by the Ld. DRT on the ground that there is delay of three days in filing the written statements.
Heard. This Tribunal is of the opinion that huge recovery of Rs.284.30 crores is involved in the present matter and same needs to be decided expeditiously.
In these circumstances, in the interest of justice the WS should be allowed to be taken on record so that the matter can be decided on merit. The Ld. Counsel for respondent bank has also no objection to the same. The prayer of the appellants is, therefore, allowed subject to the cost.
In view of the above, let WS of the appellants herein (i.e. defendants no.1 to 3) be taken on record subject to the payment of the cost of Rs.75,000/- to be paid by the appellants to the Ld. Counsel for respondent bank within one week. On payment of the cost, let Written Statement be taken on record by the Ld. DRT.
With the above directions, the present appeal stands disposed of.
