The office report dated 08.12.2022 shows that notice sent to respondent No. 3 has returned back with endorsement “addressee was not at home”. The respondent-Bank has not responded to the Waiver Application.
Let fresh steps be taken within a week by the learned counsel for the appellant for service of notice upon the respondent No. 3 by publication in the Newspapers having wide circulation in the area, where the said respondent resides. Affidavit of service along with proof of publication be filed by the next date.
Respondent-Bank may file reply by the next date if so desired, as no pre-deposit has been made. The learned counsel for the respondent-Bank submits that on account of the same, the appeal itself is not maintainable.
