In compliance of order dated 24.08.2022 & 16.11.2022 of Hon’ble Chairperson, Ld. Counsel for appellant has deposited Rs.7310/- vide TR No. 116420 dated 24.11.2022 towards payment of deficit court fee.
Received a substitution application being IA No. 438 of 2022 on 25/11/2022 along with affidavit of service filed by Ld. Counsel Mr. NriprendraNath Bain on behalf of appellant in respect of order dated 24.08.2022 of Hon’ble Chairperson.
It is observed from record that service of substitution petition has been servedeffectively upon Respondent Nos. 1, 2& 3 whereas service has not been made upon other Respondent Nos. 4 to 10. Hence, Ld. Counsel for Appellant was directed to file affidavit of service after completingthe service upon Respondent Nos. 4 to 10, vide order dated 25/11/2022. But it is observed that despite of second round of listing after the order, Ld. Counsel for Appellant is yet to appear before this bench and file affidavit of service.
The matter may be placed before Hon’ble Chairperson on 31/01/2023 as already fixed, for direction.
