The report of the Registrar dated 03.10.2022 shows that the present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 05.09.2022 passed by the DRT, Patna in S.A. No. 22/2019 and expedite application being I.A. No. 445/2022 and waiver application being I.A. No. 444/2022 have also been filed. The said report further reveals that no pre-deposit has been made, but as per demand notice dated 04.09.2018, the total dues as on 28.08.2018 was Rs. 4,46,24,672.50 plus interest and the property, as per averment made in the waiver application, has been sold for a sum of Rs. 4,33,25,070.80.
Shri S. K. Srivastava, Advocate has put in appearance on behalf of the respondent-Bank and seeks time to file his vakalatnama along with reply.
Issue notices to the remaining respondents on the waiver application by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellants within a week. Affidavit of service along with tracking report be filed by the next date.
Interim application shall be considered on the next date.
List this case on 23.12.2022 for service.
