Heard the learned counsel for the appellants on the urgency application being I.A. No. 426/2022.
Learned counsel for the appellants submits that the respondent no. 2-Auction Purchaser is trying to alienate the property, therefore, the matter may be preponed.
Learned counsel for the appellant further submits that although the respondents reside at the given address, but they are deliberately evading the service, therefore, he prays that the service of notice through paper publication may be ordered to be made.
Let the appellants take fresh steps for service of notice upon the respondents through paper publication in the newspapers having wide circulation in the area. Steps to be taken within a week. Affidavit of service along with proof of publication be filed by the next date.
In view of the above, the urgency application being I.A. No. 426/2022 is disposed off and list this case as the date already fixed i.e. 03.11.2022.
