An I.A. No. 698/2022 being urgency application has been filed by the learned counsel for the appellant for preponing the date on the ground that the appellant apprehends that the respondent-Bank in collusion with the respondent no. 2- Auction Purchaser may take the possession of the property in question, which is open land.
Learned counsel for the respondent-Auction Purchaser states that he is in possession of the property in question, which is open land and no such activity is being done by the Auction Purchaser.
The report of the Registrar dated 16.12.2022 shows that the next date already fixed in this case is 06.01.2023. There is nothing on record to show, on what basis the said apprehension has been placed. Therefore, no good ground is made out for preponing the date, therefore, the urgency application is rejected.
