Heard the learned counsel for the applicant on the urgency application being I.A. No. 432/2022.
Learned counsel for the applicant submits that under the garb of order dated 15.09.2022 passed by the D.M., Prayagraj under section 14 of the SARFAESI Act, the respondent-Bank is proceeding to take physical possession of the property, which is a residential house of the appellant, therefore, the present application may be allowed and the matter may be fixed at an early date by preponing the date as already fixed in the case for 21.10.2022.
In view of the aforesaid, the urgency application being I.A. No. 432/2022 is allowed and the date already fixed for 21.10.2022 is preponed to 14.10.2022 for waiver.
