The report of the Registrar dated 11.10.2022 shows that the present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 28.09.2022 passed by the DRT, Allahabad in S.A. No. 731/2022 and urgency application being I.A. No. 456/2022, waiver application being I.A. No. 458/2022 and Stay application being I.A. No. 457/2022 as well as exemption application being I.A. No. 459/2022 have also been filed. Report further shows that no pre-deposit has been made.
Since the matter has been taken-up, therefore, the urgency application has become infructuous. Accordingly, the same is dismissed as having become infructuous.
Shri Kush Saxena, Advocate files his vakalatnama on behalf of the respondent-Bank, who may file reply by the next date.
Issue notices to the remaining respondents on the waiver and stay applications by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
