The Appeal Dy. No. 67/2020 was declined to register as defects were not removed. The appellant filed an Appeal In Chamber i.e. M.A. 59/2021 against the order of Registrar. Hon’ble Chairperson vide order dated 26.09.2022 in the said M.A. ordered to list this case on 02.11.2022 for hearing on Appeal In Chamber and that in the meantime the appellants may remove the defects before the Registrar on 10.10.2022.

Ld. Counsel for the appellant sought time for removal of defect and inadvertently the appellant was granted time till 03.11.2022 i.e. the date fixed before Registrar. Inadvertently the case also could not be listed before Hon’ble Court on 02.11.2022.

In regard to the defect regarding seal/stamp of the firm is not affixed, Ld. Counsel states that the firm is Proprietorship Firm and the Proprietor of the Firm has signed each page of the appeal, hence, seal/stamp of the firm on each pages is not required. In regard to defect that page no. 51, 53 and 65 are not legible Ld. Counsel undertakes that he would file typed copy of the same if desired by the Court. Proper Court Fee paid . Defects reconciled except the defect regarding pre-deposit..
