In regard to defect regarding delay, Ld. Counsel states that the impugned order was passed on 25.02.2022 and the Free Certified copy of the order was issued on 09.03.2022 (page 181-183 of the Appeal. The Appeal has been filed on 08.04.2022, hence Appeal is filed within time and there is no delay.
No pre-deposit has been made. Ld. Counsel states that property has been sold by Bank in Auction for Rs. 6.33 Crore. Ld. Counsel states that he has filed Waiver Application and he will argue this point before Hon’ble Court.
This Appeal has been filed under section 18 of SARFAESI Act, against order dated 25.02.2022 of DRT, Lucknow in S.A. 170 of 2017.
