As per report of the Registrar dated 17.10.2022 shows that the present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 07.12.2019 passed by the DRT, Allahabad in S.A. No. 475/2019. The waiver application being I.A. No. 465/2022 and delay condonation application being I.A. No. 464/2022 are pending consideration.
The said report further reveals that no pre-deposit has been made and as per possession notice dated 24.09.2018, the dues against the appellant was Rs. 17,28,474/- along with interest and the property has been sold for a sum of Rs. 44.43 lacs in favour of the respondent no. 3 as stated in para no. 3 of the waiver application.
Issue notices to the respondents on waiver and delay by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 02.02.2023 for service.
