The present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 03.12.2021 passed by the DRT, Lucknow in S.A. No. 478/2019.
The report of the Registrar dated 17.11.2022 shows that the delay condonation application and stay application have been filed.
Learned counsel for the appellant submits that there is no delay in filing the present appeal, as the writ petition was filed before the Hon’ble High Court.
In view of the above, the cause shown in the application is sufficient, therefore, the application for condonation of delay is allowed and the delay in filing the present appeal is condoned.
Issue notices to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 25.01.2023 for service.
