Heard the learned counsel for the appellant.
As per report of the Registrar dated 14.11.2022 shows that the present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 09.09.2022 passed by the DRT, Patna in S.A. No. 44/2017. The said report further records that the I.A. No. 555/2022 being delay condonation application and I.A. No. 556/2022 being stay application have been filed.
Vide order impugned dated 09.09.2022, the application for condonation of delay filed in S.A. No. 44/2017 has been allowed and the S.A. has directed to be listed for hearing on 28.10.2022. In case the appellant has any grievance in allowing the application for condonation of delay, he may file appropriate application before the Tribunal below and if such application is filed, the Tribunal below shall consider and decide the same most expeditiously.
Accordingly, the appeal stands disposed off.
