Heard the learned counsels for the parties on the urgency application being I.A. No. 421/2022.

Heard the learned counsels for the parties on the urgency application being I.A. No. 418/2022.

Learned counsel for the applicant submits that four appeals are pending consideration for a single issue regarding the charge of UPFC and Bank of Baroda on the basis of tripartite agreement dated 23.06.2000. It is further contended that the parties undertake to abide the terms and conditions of the said agreement.

Perusal of the order dated 09.11.2021 shows that Shri Sandeep Arora, Advocate had filed an I.A. for impleadment of the auction purchaser, as respondent no. 4, which was allowed, but the auction purchaser has not yet been arrayed as party in the memo of appeal. Let the same be done by the next date.

The report of the Registrar dated 27.09.2022 shows that the matter is fixed for 17.11.2022, which appears to be a long. Therefore, the urgency application is allowed and the date already fixed in the case for 17.11.2022 is preponed to 12.10.2022.
