O.M.P. COMM. 555 of 2025 filed by the Respondent and already pending before this Hon'ble Court and direct both petitions to be heard and adjudicated together; and

e) Pass such other and further orders as this Hon'ble Court may deem fit and proper in the interests of justice, equity and good conscience.”

Learned counsel appearing on behalf of the petitioner submits that the latter has filed a petition, OMP (COMM.) 2/2026, before learned District Judge, Commercial, South-East, Saket Courts, challenging the arbitral award dated 24.09.2025 passed by the learned Sole Arbitrator under the aegis of Delhi International Arbitration Centre. It is further submitted that the respondent has filed OMP (COMM.) 555/2025 before this Court assailing the same aforesaid arbitral award dated 24.09.2025 and the same is pending adjudication before the learned Co-ordinate Bench of this Court wherein, vide order dated 23.12.2025, learned Co-ordinate Bench had issued notice and listed the same for hearing on 11.03.2026. It is further submitted that the respondent has also filed an execution petition, OMP (ENF.)(COMM.) 19/2026 , under Section 36 of the Arbitration and Conciliation Act, 1996, with respect to the same award, and notice has been issued in the same by the learned Coordinate Bench of this Court vide order dated 19.01.2026.

Learned counsel for the respondent, who appears on advance notice, fairly submits that he has no objection if the present petition is allowed and petition, OMP (COMM.) 2/2026, filed assailing the arbitral award dated 24.09.2025 by the petitioner before the learned District Judge, Commercial, South-East, is transferred to this Court.

petitioner as well as respondent, the same arbitral award dated 24.09.2025 passed by the learned Sole Arbitrator has been challenged. The matter in issue of both the petitions are directly and substantially the same. Therefore, in order to avoid multiplicity of proceedings and contradictory findings, it will be in the interest of justice, for the effective and proper adjudication of both the petitions, that the same are decided together by the same Court.

In view of the above, the present petition is allowed.

Petition, OMP (COMM.) No. 02/2026, under Sections 34 of the Arbitration and Conciliation Act, 1996, filed by the petitioner and pending before the Court of learned District Judge, Commercial Court–01, South-East, Saket Courts, New Delhi, is withdrawn and transferred to this Court. Let the records of the same be transferred to the Registry of this Court and tagged along with petition, OMP (COMM.) 555/2025 , for joint proceedings of both petitions on 11.03.2026.
