The present petition under Section 25-B (8) of DRC Act seeks the following prayers: -

“a. Call for the records of the Trial court of case title "Rajeev Sachdeva Vs Meenakshi Bhatia" in RC ARC No.323/2024, decided by the court of Sh. Rupinder Singh Dhiman, Ld. ARC-01, Central District, Tis Hazari Courts, Delhi.

b. Set aside the Impugned Judgment/Order dated 21.11.2025, passed by Sh. Rupinder Singh Dhiman, Ld. ARC-01, Central

District, Tis Hazari Courts, Delhi, as the leave to defend application of the petitioner has been dismissed even though there were triable issues and the respondent landlord had only filed the Eviction petition U/S-14(1) (e) DRC Act showing non-existent bonafide needs as well as there are two other shops with the respondent in the same vicinity and the same are lying vacant with the respondent, in the interest of justice and equity.”

During the course of the arguments, learned counsel for the petitioner submits that 3 months’ time may be granted to vacate the subject property.

Learned counsel for the respondent on advance notice submits that he has no objection if such time is being given to vacate and, in view of the aforesaid request, he does not press for the use and occupation charges.

In these circumstances, let the petitioner vacate the property on or before 20.08.2026.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

¶22

The present petition is dismissed as withdrawn and disposed of.

¶23

Needless to state, that the petitioner shall clear all the statutory charges, including water and electricity.

Pending application(s), if any, also stand disposed of.
