The present petition under Section 25-B(8) of the Delhi Rent Control Act seeks following prayers:-

“(a) Exercise the powers under Section 25-B(8) of the Delhi Rent Control Act, 1958 to call for and examine the records of the case leading to the passing of the impugned order dated 24.09.2022:

(b) Set aside the impugned order dated 24.09.2022 passed by the court of Ms. Deepti Devesh, Ld. SCJ-CUM-RC, Delhi in the case titled as “Hari Prakash Vs. Satya Prakash “ bearing No. RC; ARC NO. 37/2015 (5139/2016). and allow the Leave to Defend Application tiled by the Petitioner while setting aside the eviction order passed by Id. SCJ-CUMRC..”

“1. Apropos the last order dated 24.11.2025, learned counsels for the parties submit, on instructions, that the petitioner/ tenant shall vacate the subject premises and handover vacant and peaceful possession thereof to the respondent/ landlord, on or before 30.11.2026, and shall also pay an enhanced user and occupation charges @ Rs.16,000/- per month w.e.f. 01.12.2025 till the aforesaid handing over of the subject premises.

Needless to say, the tenant shall pay/ clear all electricity, water and RWA dues, including all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the landlord on or before the said date, i.e. 30.11.2026.

As such, learned counsel for the tenant seeks, and is granted, a period of two weeks for filing an affidavit of undertaking to the aforesaid effect.

Accordingly, renotify on 16.01.2026.”

None appears on behalf of the petitioner.

There was no appearance on behalf of the petitioner on the last two dates of hearing as well, i.e., on 16.01.2026 and 04.05.2026.

Affidavit of undertaking in terms of order dated 12.12.2025 has not been filed on behalf of the petitioner.

Learned counsel appearing on behalf of the respondent points out that the physical possession of the subject property has been handed over to the respondent.

In view of the above, the present petition is dismissed in default for non-prosecution and disposed of accordingly.
