The present petitions under Section 25-B(8) of the Delhi Rent Control Act, 1958 challenge the impugned order and judgment, both dated 11.07.2024 in Eviction petition No. E-311/2013 (later renumbered as E- 78371/2016) and E-312/2013 (later renumbered as E-77543/2016), respectively, under Section 14(1)(e) read with Section 25(B) of Delhi Rent Control Act, 1958;

During the pendency of the present petitions, the petitioners had showed their wiliness to vacate the subject premises which was duly recorded

in the order dated 11.12.2025 and subsequently vide order dated 23.12.2025, it was observed as under:

“1. Learned counsel for the parties , apropos talks with the tenant and the landlords respectively, submit that the tenant shall vacate the subject premises to hand over the physical and peaceful possession thereof to the landlords on or before 31.01.2026, and shall also pay user and occupation charges after finalising the figure/ amount therefor.

Needless to say, the tenant shall pay/ clear all the pending electricity, water and RWA dues, including all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the landlords on or before the said date, i.e. 31.01.2026.

Learned counsel for the tenant seeks and is granted a period of two weeks for filing an affidavit in compliance qua the above.

Renotify on 07.01.2026.”

Learned counsel for the petitioners has handed up in Court today affidavits to submit that the subject premises has been vacated by 31.01.2023 and keys of the premise have been handed over today to the respondent, who is present in Court today along with counsel. So far as the use and occupation charges are concerned, it is agreed between the parties, that the petitioners will pay a composite amount of Rs.1,50,000/- with respect to both the petitions to the respondent within three weeks from today.

The aforesaid statement is taken on record.

In view of the above, the present petitions are disposed of as not pressed.

Pending application(s), if any, also stands disposed of.
