This application under Section 151 of CPC has been filed on behalf of the Decree Holder for recording satisfaction of the Judgment and Decree dated 20.12.2011 passed by this Court in CS(OS) 2644/2000.

It is stated that during the pendency of the present execution petition, a settlement has been arrived at between the Decree Holder and the Legal Heirs of Judgment Debtor No.1 - Late Ms. Roop Inder Kaur who is survived by her two daughters i.e., Judgment Debtor No.1(a) - Ms. Satnam Sandhu Torre and Judgment Debtor No.1(b) – Ms. Meher Kaur Sandhu.

It is stated that affidavits dated 17.02.2025 and 23.05.2025 were filed

by the LRs of JD No.1 i.e., Judgment Debtor No.1(a) and Judgment Debtor No.1(b) respectively in an analogous proceedings being Test Case No. 81/2023 and in accordance with the affidavits, the matter is settled between the Parties. Paragraph Nos.5 to 9 of the present application which records the effect of the settlement read as under:

“5. That pursuant to the aforesaid affidavits dated 17.02.2025 and 23.05.2025 filed by the aforesaid LRs of the JD-I filed in the Test Case 81/2023, copies of which were also filed in the present Execution proceedings and the directions of this Hon'ble Court given in both the abovesaid matters, the said LRs of JD-1 were required to perform various acts and obligations in relation to their pending disputes with Mr. Ravi Inder Singh w.r.t. the subject matter of Test Case 81/2023 and JD-1 's claims in the present Execution Proceedings.

6. That one of the LRs of JD-1 viz. JD-l(a) Mrs. Satnam Sandhu Torre has already filed her affidavit dated 20.04.2026 as well as the affidavit dated 18.09.2025 of her husband Mr. Nicolo G. Torre (both filed vide on 20.04.2025 vide Diary Nos. 176002/2026 and 176008/2026) in the present Execution proceeding, inter alia, stating and confirming that JDl(a) has duly performed and completed all such acts and obligations as were required to be performed by her for the full implementation of the terms of the settlement recorded in her aforesaid affidavit dated 23.05.2025 filed in the Test Case 81/2023, copy whereof has also been filed and taken on record (on 28.05.2025) in the present Execution Proceedings, and further confirming that she has already received the amount of Rs. 4,25,00,000/- in full and final settlement of all her claims arising out of or relating to the present Execution Proceedings and the Punjab Lands (which are a part of the subject matter of the Test Case

81/2023) and further confirming that neither she [JD-1 (a)] nor her husband Mr. Nicolo G. Torre shall ever dispute the settlement recorded in the abovementioned affidavit dated 23.05.2025 and shall not raise any fresh claims and/or institute any fresh litigation against the Decree Holder and/or JD-2 Mr. Ravi Inder Singh w.r.t. any matter whatsoever at any point of time in future.

7. That the other LR of JD-1 viz. JD-1(b) Ms. Meher Kaur Sandhu has already filed her affidavit dated 04.03.2026 (filed on 11.03.2026 vide Diary No. 110933/2026) in the present Execution proceeding, inter alia, stating and confirming that she has duly performed and completed all such acts and obligations as were required to be performed by her for the full implementation of the terms of the settlement recorded in her aforesaid affidavits dated 17.02.2025 filed in the Test Case 81/2023, copy whereof has also been filed in the present Execution Proceedings, and further confirming that she has already received the amount of Rs. 3,25,00,000/-(through the Roopinder-Meher Private Trust) in settlement of her claims arising out of or relating to the present Execution Proceedings and the Punjab Lands (which are a part of the subject matter of the Test Case 81/2023).

That however, JD-1(b) Ms. Meher Kaur Sandhu had sought parity w.r.t. the settlement consideration being paid to JD-1(a) Mrs. Satnam Sandhu Torre and had further stated that if parity is not given she would be constrained to take legal recourse and in these circumstances, the Decree Holder and/or Mr. Ravi Inder Singh-JD-2 had agreed to the request of JD-1 (b). Therefore, in order to achieve parity w.r.t. the settlement consideration being paid by the Decree Holder to both the LRs of JD-1 (Late Mrs. Roopinder Kaur), a further sum of Rs.1,00,00,000/- is payable by the Decree Holder to Roopinder-Meher Private Trust

[for and on behalf of Ms. Meher Kaur Sandhu JD-l(b)] in terms of the revised understanding arrived at amongst them, demand draft/ banker's cheque for which sum drawn in the name of Roopinder-Meher Private Trust will be handed over by the Ld. Counsel for the Decree Holder to the Ld. Counsel of JD-1(b) Ms. Meher Kaur Sandhu at the time when her no objection to the prayers in this application is conveyed and the present application is allowed.

9. In view of the aforesaid, upon the handing over of the demand draft/banker's cheque for Rs. 1,00,00,000/by the Ld. Counsel for the Decree Holder to the Ld. Counsel of JD-1 (b) Ms. Meher Kaur Sandhu and after taking - (i) the affidavit dated 20.04.2026 of JD-1(a) filed in the present Execution Proceedings, (ii) the affidavit dated 18.09.2025 of Mr. Nicolo G. Torre, husband of JD-l(a) filed in the present Execution Proceedings, (iii) the affidavit dated 04.03.2026 of JD1(b) filed in the present Execution Proceedings and (iv) copy of the affidavit dated 17.02.2025 of JD-1(b) filed in the Test Case 81/2023, on record of the present Execution Proceedings pending before this Hon'ble Court, the same i.e. the present Execution Proceedings can be finally disposed of by recording that the Decree under execution stands fully satisfied and by binding the parties to their undertakings recorded in their respective affidavits filed and/or taken on record in the present Execution Proceedings before this Hon'ble Court.”

It is stated that in terms of the settlement, a Demand Draft of Rs.1,00,00,000/- has been handed over by the Decree Holder to the Trust i.e., Roopinder-Meher Private Trust on behalf of Judgment Debtor No.1(b) – Ms. Meher Kaur Sandhu.

are taken on record, the details of which have been given in Prayer Clause (a) of the present application which reads as under:

“(a) take - (i) the affidavit dated 20.04.2026 of JD-1(a) filed in the present Execution Proceedings, (ii) the affidavit dated 18.09.2025 of Mr. Nicolo G. Torre, husband of JD-1(a) filed in the present Execution Proceedings, (iii) the affidavit dated 04.03.2026 of JD1(b) filed in the present Execution Proceedings and (iv) copy of the affidavit dated 17.02.2025 of JD-1(b) filed in the Test Case 81/2023, on record of the present Execution Proceedings Ex. (P). No. 18 of 2019.”

In view of the above, the present execution petition is disposed of in terms of the settlement arrived at between the Parties. Pending applications, if any, also stand disposed of.

The Parties shall be bound by the affidavits filed in support of the present application.

The next date of hearing i.e., 09.09.2026, stands cancelled.
