This is an application on behalf of the Plaintiff under Order XXIII Rule 1 of the CPC for withdrawal of the present suit.

The instant suit is one for partition of suit property bearing House No.M-11A Malviya Nagar, New Delhi-110017 admeasuring 100 sq. yds..

A preliminary decree was passed on 27.11.2024 whereby the share of the Plaintiff was declared as 1/3^rd in the suit property. The other Defendants who are siblings of the Plaintiff, were declared to be owners of 1/3^rd area of the suit property.

It is stated that the Plaintiff does not intend to pursue the present suit and seeks withdrawal of the suit. The Plaintiff’s son, who is present in Court, states that he has instructions from his father to state that the suit is being withdrawn without any coercion, pressure or undue influence from the
