Sh. Mukesh Kumar Vs M/S Gliders Infrastructure Pvt. Ltd.

The present application under Order XXIII Rule 1 read with Section 151 of the CPC has been filed by the Plaintiff seeking withdrawal of the present suit in terms of the settlement which has been entered into between the parties.

The present suit has been filed with the following prayers:

<(a) Pass a decree of declaration in favour of the plaintiff and against the defendant declaring that sale deed executed on 20-05-2013 registered no. 6328 volume no. 3183 on pages 175 to 181 dated 03-012014 is illegal, null and void and the same be directed to be delivered up and cancelled.

(b) Grant a decree of Permanent Injunction in favour of the plaintiff and against the defendant restraining the defendant its servants, agents and representative from creating any third party interest, selling or

encumbering property i.e agricultural land in khata khatoni no. 178/108 bearing khasra no. 9/76/1(1-6), 5(4-12), 10//1(4-16), 2/3(2-14), 9(4-12), 10(4- 12), 11/1(1-3) total admeasuring 23 bigha and 15 biswas I situated in the revenue estate of village Mungesh Pur, Delhi- 39, and from dispossessing the plaintiff therefore ;

(c) Allow costs in favour of the plaintiff and against the defendant.

(d) Pass any other or further relief/s which this Hon'ble Court may deem fit and proper in favour of the plaintiff in the facts and circumstances of the present case.=

The Plaintiff is present in the Court today. He states that the Settlement Agreement has been entered into with his consent and he is aware of the contents of the Settlement Agreement and therefore, seeks permission to withdraw the instant suit.

Paragraph 2 of the Settlement Agreement indicates that a sum of Rs. l,55,00,000/- is to be paid by the Defendant to the Plaintiff. The amount has been given to the Plaintiff in Court today by way of a demand draft drawn from HDFC Bank bearing Draft No. 063424 dated 10.12.2025 of Rs. l,55,00,000/- in favour of Mukesh Kumar.

In view of the above, the instant suit is disposed of in terms of the Settlement Agreement.
