This application is filed jointly on behalf of Plaintiff and the Defendant under Order XXIII Rule 3 read with Section 151 CPC for recordal of settlement between parties.

This suit was instituted on behalf of the Plaintiff inter alia seeking a decree of permanent injunction against the Defendant restraining the Defendant and all others acting on its behalf from manufacturing, marketing, advertising and selling its agricultural product i.e., Rotavators Blade and/or any other agricultural/cognate/allied products bearing Plaintiff’s registered trademark ‘SHAKTIMAN’.

During the pendency of the suit, parties were referred to the Delhi High Court Mediation and Conciliation Centre, where they have amicably

settled their inter se disputes and a Settlement Agreement dated 23.03.2026 has been executed and signed, copy of which has been placed on record. As per the Settlement Agreement, learned counsel for the Defendant has handed over a Demand Draft in the sum of Rs.1,00,000/- to learned counsel for the Plaintiff, copy of which has been filed along with the application.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties.

In light of Settlement Agreement between the parties, the suit is decreed. Terms of settlement shall form a part of the decree and needless to state, bind the parties thereto.

Suit stands disposed of along with pending applications.

Plaintiff is held entitled to refund of entire court fees in accordance

with the Court Fees Act, 1870.
