Petitioners seek quashing of case FIR No. 337/2019 of PS Prashant Vihar for offence under Section 376/354 IPC on merits.

Learned counsel for petitioners submits that the impugned FIR is oppressive and abuse of process by daughter-in-law of petitioner no. 1, who is embroiled in a matrimonial litigation with his elder son. It is also submitted by learned counsel that the prosecutrix ( daughter-in-law of petitioner no. 1 ) continues to file such obnoxious complaints against petitioner no. 1 and his family members.

Learned APP assisted by IO/ACP Sanjita submits that trial has concluded in the impugned FIR and the matter is listed for final arguments, so it would not be proper to invoke inherent powers to quash the FIR. On this aspect, learned counsel for petitioners submits that trial had concluded

more than six months ago but somehow the prosecutrix is succeeding in getting the final arguments deferred repeatedly.

As reflected from record, by way of order dated 15.07.2024, a coordinate bench of this Court in W.P. (Crl.) 2110/2024 had directed the trial court to conclude the trial within one year.

Considering the totality of circumstances, after part submissions, learned counsel for petitioners seeks permission to withdraw this petition. 6. As requested, the petition is dismissed as withdrawn. Pending applications also stand disposed of.

However, keeping in mind the aforesaid, especially order dated 15.07.2024 mentioned above, learned trial court is directed to positively conclude final arguments on 07.08.2026 when the final arguments are stated to be scheduled and thereafter positively within one month, the trial court shall pass final judgment. If for some reason, the trial has to be adjourned on 07.08.2026, it shall not be adjourned for more than three days .
