During the pendency of the proceedings the Trial Court granted the Petitioner interim bail to enable marriage; the Petitioner and Respondent No. 2 married on 24.11.2025 per Hindu rites, whereafter he was admitted to regular bail. Respondent No. 2 stated before the Court that she was residing happily with the Petitioner as his legally wedded wife, had no subsisting grievance, did not wish to pursue the proceedings and had no objection to quashing. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’ ) seeking quashing of FIR No. 0357/2025 , registered at Police Station Vasant Kunj North, New Delhi, for the offences punishable under Sections 69/351(2) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘ BNS ’) and all consequential proceedings emanating therefrom.

were acquainted with each other and entered into a consensual relationship. During the pendency of the proceedings, the Petitioner was granted interim bail by the learned Trial Court to enable the parties to solemnize their marriage. Pursuant thereto, the Petitioner and Respondent No. 2 solemnized their marriage on 24.11.2025 in accordance with Hindu rites and ceremonies. Thereafter, the factum of marriage was brought to the notice of the learned Trial Court, whereupon the Petitioner was admitted to regular bail.

6. Learned counsel for the Petitioner submits that the Petitioner is on regular bail and that the parties have been living together peacefully ever since their marriage.

7. On a query put by this Court, Respondent No. 2 states that she is residing happily with the Petitioner as his legally wedded wife. She further states that she has no subsisting grievance against the Petitioner and does not wish to pursue the present criminal proceedings. She has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed.

Having regard to the peculiar facts and circumstances of the present case, particularly the fact that the parties have solemnized their marriage and are presently living together peacefully as husband and wife, this Court is of the considered opinion that no useful purpose would be served by permitting the criminal proceedings to continue. On the contrary, continuation of the proceedings would unnecessarily disturb the settled matrimonial life of the parties. T here is no legal impediment in quashing the FIR in question.
