By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks parole for a period of 02 months.

the Delhi Police Rules, 2018 since his overall jail conduct was not satisfactory.

Learned counsel appearing for the petitioner submits, that though the petitioner’s prison record is as narrated in the nominal roll, it ought to be considered that the petitioner was last granted parole in April-May 2023; and has not been granted parole or furlough thereafter.

Learned counsel submits, that the petitioner was last awarded prison punishment on 17.09.2025, for a minor infraction of having fought with the fellow inmate, and was served a warning. Learned counsel also submits, that the petitioner has already suffered prison punishments that were awarded to him for his other infractions within prison.

It is pointed-out that the petitioner has served actual judicial custody of about 19 years and 04 months; and has earned remission of about 04 years and 02 months.

It is also noticed that the petitioner has been granted parole on 03 prior occasions; and furlough on 05 earlier occasions.

Though the petitioner’s overall jail conduct is ‘unsatisfactory’; but his jail conduct over the last one year has been recorded as ‘satisfactory’, except for the punishment dated 17.09.2025 for having fought with a fellow inmate, for which he was administered a warning.

The petitioner seeks parole for re-establishing social ties and as the record shows, he has not been released from custody for the last about 03 years.

Upon the conspectus of the foregoing, especially considering the length of custody undergone, and the fact that the petitioner was last

granted parole from 10.04.2023 to 08.05.2023, this court is persuaded to allow the present petition. The petitioner is granted parole for a period of 04 weeks , subject to the following conditions :

14.1. The petitioner shall furnish a personal bond in the sum of Rs.15,000/- (Rs. Fifteen-Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;

14.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address as per prison records/as mentioned in the petition ;

14.3. The petitioner shall present himself before the S.H.O., P.S.: Okhla Industrial Area, Delhi every Monday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose ;

14.4. The petitioner shall furnish to the S.H.O., P.S.: Okhla Industrial Area, Delhi a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times ;

14.5. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

¶40

14.6. The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any ;

14.7. Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.
