By way of the present petition, the Petitioners seek quashing of FIR bearing No. 332/2021, registered at Police Station Shahbad Dairy, Delhi, for the commission of offences punishable under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the “IPC”) and all consequential proceedings emanating therefrom.

Petitioner No.1 is the husband of Respondent No.2 and Petitioner No.2 is the father-in-law of Respondent No.2. The Petitioners and Respondent No.2 are present before this Court and have been identified by

Briefly stated, the facts of the present case are that the marriage between Petitioner No.1 and Respondent No.2 was solemnized on 22.11.2015 according to Hindu rites and ceremonies. Out of the said wedlock, one male child, aged about 9 years, was born. Owing to temperamental differences and matrimonial discord, disputes arose between the parties, pursuant to which they started living separately. Thereafter, on the complaint lodged by Respondent No.2, the aforesaid FIR came to be registered against the Petitioners and other family members. However, with the intervention of the Delhi Mediation Centre, Rohini Courts, Delhi, the parties have amicably resolved all their disputes vide Settlement Agreement dated 18.08.2025.

As per the terms of the settlement, the parties have agreed to dissolve their marriage by way of mutual consent and Petitioner No.1 has agreed to pay a total sum of Rs. 8,85,000/- towards full and final settlement of all claims of Respondent No.2, including stridhan, maintenance, permanent alimony and all other ancillary claims arising out of the matrimonial relationship.

Learned Counsels for both the parties submit that the parties have amicably settled their disputes, and today, Petitioner No. 1 has handed over a Demand Draft bearing No. 236721 dated 13.05.2026, drawn on Punjab National Bank, in the sum of Rs. 2,85,000/- to Respondent No. 2, Ms. Priyanka, towards full and final settlement. It is submitted that after the aforesaid payment, nothing remains due and payable between the parties.

the settlement voluntarily, out of her own free will and without any pressure, coercion or undue influence. She further states that all disputes between the parties have been amicably resolved and she has no objection if the FIR in question and proceedings emanating therefrom are quashed.

This Court notes that the custody of the minor child is with respondent no. 2 and the future right of the child will not be affected by virtue of this compromise.

In view of the fact that the parties have amicably resolved their disputes out of their own free will and without any coercion, no useful purpose would be served in continuing the present criminal proceedings, rather the same would only perpetuate acrimony between the parties. It would thus be in the interest of justice to quash the FIR in question and proceedings arising therefrom. There is no legal impediment in quashing the present FIR.

Accordingly, FIR bearing No. 332/2021 dated 29.06.2021, registered at Police Station Shahbad Dairy, Delhi, for the offences punishable under Sections 498A/406/34 IPC, and all consequential proceedings emanating therefrom are hereby quashed.
