Shri Niwas & Anr. Vs the State (Govt of NCT of Delhi) & Anr.

By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners seek quashing of case FIR No. 101/2024 dated 19.01.2024 registered under sections 323/354/308/34 of the Indian Penal Code, 1860 (‘IPC’) at P.S.: Shahbad Dairy, Delhi. 2. Chargesheet dated 22.03.2024 has also been filed in the matter.

The petition is premised on Amended Compromise Deed dated 06.01.2025, whereby the petitioners, respondent No. 2 and two other injured persons namely Mr. Rajesh Kumar and Mr. Suraj have resolved the matter amicably.

Though section 308 of the IPC was also indicated in the FIR, it would appear that the provision was added because an injury had been sustained by one of the victims (a girl) on the head. However, she did not sustain any serious hurt.

The injuries sustained by the other 02 victims were also simple in nature.

It is submitted that the dispute was amongst the family members; and the petitioners had also filed a cross-FIR, which has already been closed.

The petition is also supported by affidavits of the petitioners, respondent No. 2 and Mr. Rajesh Kumar and Mr. Suraj, alongwith proof of their IDs.

The contesting parties are present in court. Their credentials have been verified and they have also been identified by their respective counsel.

The court has interacted with respondent No.2 as well as Mr. Rajesh Kumar and Mr. Suraj, as also with petitioners, who have confirmed that they have now resolved the matter; and an Amended Compromise Deed dated 06.01.2026 has been signed by them, closing all issues amicably. Parties now wish to live in peace and harmony going forward.

Mr. Anand V. Khatri, learned ASC confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.

Accordingly, case FIR No. 101/2024 dated 19.01.2024 registered under sections 323/354/308/34 of the IPC at P.S.: Shahbad Dairy, Delhi is quashed. All proceedings arising therefrom also stand closed.

Petition stands disposed-of.
