By way of present petition, the petitioner seeks quashing of FIR bearing no. 153/2017, registered at Police Station Uttam Nagar, Delhi for the commission of offence punishable under Section 307 of the Indian Penal Code, 1860 (hereafter ‘ IPC ’).

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Uttam Nagar, Delhi.

Briefly stated, facts of the present case are that on 27.03.2017, a scuffle had taken place between the petitioner and respondent no. 2, in which respondent no. 2 had sustained injuries. Based on the aforesaid event,

the present FIR was registered on the same day against the petitioner under the relevant section. It is stated that both the parties have amicably settled the present matter vide Memorandum of Understanding, dated 28.03.2024, entered between them.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties and has received Rs. 15,000/- as total compensation. Respondent no. 2 further states that he has no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 153/2017, registered at Police Station Uttam Nagar, Delhi for the commission of offence punishable under Section 307 of IPC and all consequential proceedings emanating therefrom are quashed, subject to costs of ₹5,000/- to be deposited by the petitioner with Delhi High Court Bar Clerk’s Association Fund within a period of two weeks from date and the compliance report of the same be filed with the Registry of this Court within a period of one week, thereafter.
