The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter, ‘BNSS’), seeking quashing of FIR No. 69/2026 , registered at Police Station Jyoti Nagar, Delhi, under Sections 115(2)/126(2)/74/3(5) of the BNS, and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

Issue notice. The learned APP accepts notice on behalf of the State.

The petitioner and respondents no. 2 are present before this Court and have been identified by their counsel and Investigating Officer.

Brief facts of the case are that, pursuant to the aforesaid dispute, Respondent No. 2 lodged a complaint against the petitioners, resulting in registration of the aforesaid FIR. Subsequently, with the intervention of

respectable persons and well-wishers of both parties, the matter was amicably settled and a Memorandum of Understanding/Settlement Deed dated 29.08.2026 was executed between the parties.

As per the settlement, Respondent No. 2 has agreed to cooperate in the quashing of the FIR and has also filed an affidavit stating that the settlement has been arrived at without any force, pressure or undue influence and that she does not wish to pursue the proceedings arising out of the aforesaid FIR against the petitioners.

On a query made by this Court, Respondent No. 2, who has been duly identified by the Investigating Officer, states that she has entered into the settlement with the petitioners of her own free will and without any pressure, coercion or threat. She further states that she has no objection if the present FIR and the proceedings emanating therefrom are quashed.

In view of the settlement arrived at between the parties and the statement made by Respondent No. 2, this Court is of the view that the parties have amicably resolved their disputes and that Respondent No. 2 does not wish to pursue the criminal proceedings any further. In these circumstances, continuation of the proceedings would serve no useful purpose. 9. Accordingly, FIR No. 69/2026, registered at Police Station Jyoti Nagar, Delhi, under Sections 115(2)/126(2)/74/3(5) of the BNS, along with all consequential proceedings emanating therefrom, is hereby quashed. 10. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 11. Copy of the order be communicated to the learned Trial Court for necessary action and compliance.
