The present petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the petitioner

before the Court, alleging that his detention beyond 23.01.2026 is illegal and arbitrary.

The respondents, to justify the detention of the petitioner beyond 23.01.2026, are relying on the custody warrant issued by the learned Duty JMFC in the special circumstances owing to the Republic Day celebrations and the non-availability of police personnel for production of the detenues.

The petitioner has since filed a Writ Petition challenging the said custody warrant in W.P.(Crl.) 505/2026, titled Ritik Bajaj v. State NCT of Delhi & Anr. , which is listed before the learned Single Judge of this Court on 11.02.2026.

In view of the petitioner having availed of his remedies to challenge the same, no further orders are required in the present petition. The learned Single Judge would determine the validity of the same on its own merits and issue appropriate direction on the same.

The petition is, accordingly, disposed of.

We make it clear that we have not expressed any opinion on the merits of the claims of either of the parties.
